Personal bankruptcy administrator register issued

Shenzhen has issued the country’s first register of personal bankruptcy administrators, Shenzhen Special Zone Daily reported yesterday.

The register officially went into effect at a ceremony held by the Shenzhen Municipal Justice Bureau and the Shenzhen Bankruptcy Affairs Administration.

The register has a total of 40 administrators, and they will engage in newly accepted personal bankruptcy cases to improve handling the cases’ quality and efficiency. The administrators will also push forward pilot reforms in the personal bankruptcy system.

A bankruptcy administrator is the executor in Shenzhen’s bankruptcy handling system and undertakes many important duties such as the review of personal bankruptcy claims, property investigation, distribution of bankruptcy property and supervision.

The administrator plays an important role in helping the courts hear bankruptcy cases and the municipal bankruptcy affairs administration to strengthen the management of administrative affairs.

The register consists of 33 local and seven nonlocal administrators. Five of the seven nonlocal administrators are in the Guangdong-Hong Kong-Macao Greater Bay Area, including two in Guangzhou, one in Dongguan, one in Foshan and one in Huizhou. The other two are from Shanghai and Hangzhou, respectively, according to the report.

It is reported that personal bankruptcy cases, in light of its characteristics, require administrators to be familiar with both bankruptcy procedures and various litigation businesses such as marriage and family, as well as bank card disputes. A personal bankruptcy case is also more demanding than an enterprise bankruptcy case in terms of team stability.

In the city’s newly accepted personal bankruptcy cases, creditors may recommend administrators to the people’s court from the register. If the court notifies the bankruptcy affairs administration to propose an administrator, the administration shall propose the administrator from the register.
